MyBestFive.com Terms and Conditions – 1 November 2019

This Agreement is a legal document that details your ("you" or “your”) rights and obligations, and those of MyBestFive.com ("MBF", "we", "us" or "our") in relation to this site and the services offered by MBF. You must take the time to read and understand it. By using our website or registering for the MBF service, you agree to the terms of this Agreement and this Agreement may change from time to time without any notification being sent to you. It is in your best interest to check the date at the top of this page and note when the last changes were implemented. Also, read our Privacy Policy (this also contains our Cookie Policy). 

Types of membership

Membership is open to anyone 16 years of age or over. mbf membership to the site is currently FREE of all charges for a period of 3 months; at this time it may be renewed - although not guaranteed -  automatically every 3 months unless you instruct us otherwise. Further renewals or upgrades after the first 3 months will not include any free credits. It may be necessary at some point in the future to make a charge for mbf membership or for any further access to the site’s resources. 

mbf members are free to roam the site, enter content, search for other members.

1. mbf membership is FREE and mbf members may contact a maximum of 3 people (3 credits) without charge.

2. Top up the credits through PayPal at £40 per 5 or £70 for 10 credits.

3. mbf members can do a free search for other users but to read their profile and make contact with them costs 1 credit per profile.

4. Currently, mbf membership is free and may be renewed automatically every 3 months. This will not include any credits. There may be a charge levied at some time in the future but since we do not ask for credit card information when Registering nothing can be changed without your knowledge or consent.

5. If you do not log in to the site within any 3 month period your free membership will be made inactive.

6. If you ask for your account to be terminated it cannot be renewed free of charge; to gain future access you would be asked to rejoin as a vip or Life Member.

vip members pay £100 per year and have unlimited access to the site and an unlimited number of credits for that year. They may search and contact as many people as they wish and this includes the Personals section.

Life Membership pay £500 and have complete access without limits - forever! Never pay another penny for the full use of this site.

No Refunds are given on any of the above membership offers

We reserve the right to add or remove services from any or all of the above membership types. We may also make some items free to use when they may otherwise incur a charge; we may also make a charge for some items that are sometimes free to use. You may not be notified and must check back to this Agreement to see what changes have been made.

Registration

It is your responsibility to ensure that your Registration and Personal Profile details are correct and current. You warrant by registering for free membership or paid for membership that you are over the age of 16 and that the details you enter are true and correct. Should you change location or change your email address please make sure you change your Edit personal details page (there is a link on your My Home page).

Privacy Policy

Please read and note the conditions specified in our Privacy Policy. It forms a part of this Agreement and is subject to change without notice. It is in your interests to read the Privacy Policy from time to time. Note also the date at the top of the page, it will indicate the date the last changes were made. The Cookie Policy is also included in this document.

Termination or Refunds of Membership Fees

We do not refund any portion of your Membership fees for any reason whatsoever, whether terminated by the company or cancelled by the member.

If your account is terminated or is not renewed after expiration it will become inactive. Inactive accounts may not show any of the content previously entered into the site unless they are Life Members and terminated by the member; membership may only be deleted on request by the member concerned.

We reserve the right to keep onsite any submitted articles for six months or more from the date of posting.

On-Site Advertising: 

We reserve the right to place paid (or unpaid) advertising within any area of this web site. This includes Groups where we may have a specific type of advertising model. We may also place random adverts in selected (by us) areas of the site as we feel appropriate. Members do not have this right and it is a breach of these Terms & Conditions if they place banner ads or other forms of commercial advertising on this web site. 

Use, Misuse and Abuse of MyBestFive.com

USE: It is your responsibility to ensure the information you post or communicate is accurate and true and does not misrepresent your status or position.

MISUSE: Misuse includes using what is generally considered as unacceptable or inappropriate language or behaviour - swearing, obscene language, pornographic material, criminal or misleading information, threatening, criminal or racist comments. You may use free speech within your own private area except for libellous, racist, threatening, criminal or illegal comments or material. You agree to only submit materials which are your own original work. You must not violate, plagiarise, or infringe the rights of third parties including copyright, trademark, trade secrets, privacy, publicity, personal or proprietary rights. Advertising, other than paid advertising through the site administrators, the promotion or sale of products or services is considered illegal for this site and your membership may be terminated if you misuse the site for this purpose. You may only give out your own postal address details, other web site details, email addresses, phone numbers, or other forms of communication, to individual members or users. You cannot do this en masse, such as through the Message Board. You may make personal contact but only for personal and non-commercial contact. You cannot use any part of this web site for selling products or services or for monetary gain other than through MBF's own advertising sections. Any misuse of this site may cause your Membership to be terminated and you will not be entitled to any refund or portion of a refund. Any illegal or criminal use of this site will be reported to the appropriate authority. It is not acceptable to use text, photos, images or pictures or links that are hidden - ie not visible since they are the same colour as the background or hidden by any other means or reason.

ABUSE: If you are reported as using libellous or abusive language; threatening behaviour; harass, stalk or break the Terms & Conditions or Privacy Policy of this web site, you may have your Membership terminated. If this happens your details will be deleted and you will forfeit any remaining time-period of your Membership. You will not be entitled to any refund or portion of a refund. You will not be entitled to rejoin this web site again as an mbf, vip or Life Member without our prior consent.

If you see or know of any abuse on this web site or abuse to any mbf, vip or Life Member, please report it to us through the Report Abuse link at the foot of the page.

Disclaimer

We cannot know if any person registered on this site is giving out true or false information and we cannot accept responsibility for any events that may occur due to this information. It is for each person to evaluate all information and to take responsibility for their own actions. People may assume a false identity and give out false details about themselves. You use this site and its information at your own risk. Be prudent before giving out personal information and identification.

Intellectual Propert

All material on this web site, including material supplied by any Member(s) or Non-Member becomes the property of MBF. You automatically grant us irrevocable, worldwide, transferable, non-exclusive and royalty-free rights to sublicense, copy, edit, modify, sell, display, transmit, transfer, stream and distribute this material in any form or media or other works and otherwise exploit such Member Content only on, through or by means of the Site, Application or Services. Message Board messages and synopsis of Interests may be posted on social network websites automatically.

Legal

This Agreement and the Privacy Policy are subject to and governed by and in accordance with the laws of England and Wales. This agreement takes preference - either previous or future - over any other agreement, copyright, right or terms & conditions, for any and all countries.
